Copyright & DMCA Policy
1. Ownership of Site Content
All content available on drbognerhealth.com and any subdomain, page, blog, podcast, video, social-media account, or affiliated property operated by Bogner Health LLC (collectively, the “Site”), including without limitation text, articles, blog posts, podcasts, audio recordings, video, transcripts, images, graphics, infographics, logos, downloadable resources, slide decks, e-books, course materials, protocols, custom plans, software, look-and-feel, and the selection and arrangement of content (collectively, the “Content”), is the sole and exclusive property of Bogner Health LLC or is used under license from third parties. The Content is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
The marks “Bogner Health,” “Dr. Bogner,” “Researched Elements,” “Gut Balancing,” “DCL Laser,” “Autism is Biomedical,” and any associated logos, slogans, and trade dress are trademarks or service marks of Bogner Health LLC or its affiliates. Other product and company names mentioned on the Site may be trademarks of their respective owners.
2. Limited License
Subject to your continued compliance with our Terms of Service and this Policy, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view publicly available Content for your own personal, non-commercial, informational use. No other rights are granted, by implication, estoppel, or otherwise. All rights not expressly granted are reserved.
3. Prohibited Uses
Without our express prior written consent, you may NOT, and may not permit any third party to:
- Copy, reproduce, republish, distribute, mirror, frame, deep-link, embed, publicly display, publicly perform, broadcast, retransmit, syndicate, sell, license, sublicense, or otherwise commercialize any Content, in whole or in part, in any medium now known or hereafter developed;
- Modify, adapt, translate, create derivative works of, decompile, reverse engineer, or attempt to derive source code from the Site or any Content;
- Remove, obscure, or alter any copyright, trademark, watermark, attribution, or other proprietary notice;
- Use any robot, spider, scraper, crawler, automated agent, headless browser, or similar means to access, harvest, extract, index, or copy any Content or data;
- Use any Content (including text, audio, transcripts, images, podcasts, videos, or any output derived from such Content) to train, validate, fine-tune, prompt, augment, retrieval-index, embed, or otherwise develop or improve any artificial intelligence, machine learning, large language model, generative AI system, retrieval-augmented generation system, vector database, or similar technology, whether commercial or non-commercial, except with our express prior written license;
- Reproduce or redistribute any Content for purposes of training, replicating, or competing with our services or products;
- Use any Content in a manner that infringes our rights or those of any third party.
4. Permission Requests
Requests to use Content beyond the limited license granted above must be submitted in writing to [email protected] and must specify the Content requested, the intended use, the medium, the duration, the audience, and any commercial terms. We are under no obligation to grant any request and may, in our sole discretion, grant, deny, or condition our consent.
5. Attribution and Brief Quotation
Brief, properly attributed quotations from publicly available Content for purposes of news reporting, academic commentary, or scholarly criticism may be permitted under the doctrine of fair use, provided the use does not exceed what fair use permits and includes a clear citation to Bogner Health LLC and the original Site URL. We reserve the right to challenge any use we believe exceeds fair use.
6. Anti-AI / No Machine-Learning Use
We expressly prohibit, and do not consent to, the use of any Content, in whole or in part, for the development, training, fine-tuning, validation, testing, evaluation, retrieval-augmentation, embedding, or operation of any artificial intelligence or machine-learning system. This prohibition applies regardless of whether such use is by a human, a bot, an agent, an API, or any other means; whether the use is commercial or non-commercial; and whether the AI system is text-based, multi-modal, image-based, audio-based, or otherwise. Any unauthorized use of Content for such purposes is a material breach of our Terms of Service and an infringement of our intellectual property rights.
Bots, crawlers, and AI agents that ignore robots.txt, sitemap directives, “noai,” “noimageai,” or similar machine-readable signals are not authorized to access the Site, and any access in violation of those directives is unauthorized within the meaning of the Computer Fraud and Abuse Act and analogous state laws.
7. Reporting Copyright Infringement (DMCA Notice)
We respect the intellectual property rights of others and respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512. If you believe content available on the Site infringes your copyright, please send a written notice to our designated agent containing the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive copyright that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative list);
- Identification of the material claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (e.g., the URL);
- Your contact information (address, telephone number, and email address);
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

We have registered our designated agent with the U.S. Copyright Office in accordance with 17 U.S.C. § 512(c)(2). Misrepresentations in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).
9. Counter-Notification
If you believe content you posted has been removed in error or as a result of misidentification, you may submit a written counter-notification to our designated agent containing:
- Your physical or electronic signature;
- Identification of the material that was removed and the location at which it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which you reside (or, if outside the United States, the U.S. District Court for the Eastern District of Michigan), and that you will accept service of process from the complainant or its agent.
10. Repeat Infringer Policy
We will, in appropriate circumstances and at our sole discretion, terminate the access privileges of users determined to be repeat infringers.
11. Trademark Complaints
Allegations of trademark infringement should be sent to the same designated agent at [email protected] with comparable information sufficient to identify the alleged infringement and the trademark rights at issue.
12. Enforcement
Bogner Health LLC takes intellectual property protection seriously. We may, without prior notice and at our sole discretion, pursue all remedies available at law or in equity — including injunctive relief, statutory damages, actual damages, profits, attorneys’ fees, and costs — against any party that violates this Policy or infringes our intellectual property rights.
13. Severability and Governing Law
If any provision of this Policy is held unenforceable, the remaining provisions remain in full effect. This Policy is governed by the laws of the State of Michigan and applicable federal law, without regard to conflict-of-law principles.
